In force In force since Apr 1, 2025
What it means for contractors
More for you →Pay subcontractors within 7 days of receiving payment. If the owner doesn't pay, you still owe them by day 35.
What changes
Manitoba's prompt payment regime was proclaimed in stages. Specified sections took effect November 14 and 15, 2024, and the rest on April 1, 2025. An owner must pay a proper invoice within 28 days, or give a notice of non-payment within 14 days (s. 90). A contractor must pay its subcontractors within 7 days of receiving payment (s. 92). If the owner does not pay, the contractor must still pay within 35 days of the invoice, and the deadline moves down the chain by 7 days per tier (ss. 93, 98). An adjudicator's decision binds the parties until a court, arbitration or written agreement decides otherwise (s. 118). A contractor's lien can be registered within 60 days after substantial performance or abandonment (s. 43).
