Renovation disputes in Prince Edward Island: small claims up to $16,000

How renovation money disputes fit Prince Edward Island's small claims limit of $16,000, what is excluded, fees and what to prepare.

Contracts Easy Nov 1, 2026

When a renovation ends in a money dispute, the first question is which court can hear it. In Prince Edward Island small claims can hear claims up to $16,000.

The limit

In Prince Edward Island, small claims are heard by the Small Claims Section of the Supreme Court. The maximum claim is $16,000, raised from $8,000 in 2017.

Costs are capped

The court may order a party to pay the other side's costs of up to 15% of the amount claimed or of the value of the property sought.

Rules

The Small Claims Section rules were re-approved in 2023 with the $16,000 threshold kept.

Serving the claim

A statement of claim must be served on the defendant personally, or by one of the alternatives to personal service set out in the Small Claims Rules, and within six months after it is issued; the court can extend that time. A defendant served in Prince Edward Island has 20 days to file a statement of defence. A defendant served outside the province has 40 days.

The settlement conference

Once a defence is filed, the clerk sets a settlement conference, which must be held within 60 days after the first defence is filed unless the prothonotary orders otherwise. Its purpose is to settle the case or narrow the issues. Parties attend in person or, if the court allows, by phone or video. If you need someone else's approval to settle, such as a business partner or insurer, arrange to reach that person by phone during the conference.

Missing the conference costs money

A party who skips the settlement conference after notice can face costs, dismissal of all or part of the claim, or being noted in default. A party who comes so unprepared that the conference is wasted can be ordered to pay costs, normally capped at $100. Bring the contract, change orders, invoices, payments, photos and a list of witnesses.

Larger renovation disputes

Many full renovation contracts exceed $16,000. If yours does, you may need the general civil process, or decide to claim only up to the limit; get advice before abandoning part of a claim.
